Denise saw an advertisement in her local newspaper stating, ‘Take out a subscription to ‘Teenager World’ magazine for only £12 a month. Teenager World contains articles and news on topical issues teenagers are really interested in! Get your teenager reading high quality literature to improve their reading and writing skills.’ Teenager World is published by Aracne publishers.
Hoping that reading Teenager Word magazine will help her son, Mark, develop an interest in reading, Denise took out a subscription.
The contract Denise agreed to with Aracne publishers when she took out the subscription contained (inter alia) the following terms:
1. Your subscription is for a period of one year.

2. Customers may cancel the subscription at any time by giving Aracne publishers notice in writing and paying a cancellation charge equivalent to six months subscription fees.

3. Aracnereserve the right to cease publication of Teenager World at any time if it becomes economically unviable to continue publishing the magazine.

Denise has now received three copies of Teenager World. She is surprised to see that it contains articles on history and current developments in science (which her son Mark is not interested in), shocked to see that it is written in poor English and disappointed that Mark prefers to play video games to reading the magazine.
Advise Denise whether she has a right to cancel her subscription without paying the six months cancellation charge under;
a) The Misrepresentation Act 1967, and
b) S.13 of the Sale of Goods Act 1979, and
c) The Unfair Terms in Consumer Contracts Regulations 1999
