The Uniform Commercial Code (UCC)

The Uniform Commercial Code (UCC) was written by a group of legal scholars and adopted by elected state legislators (many of whom tend to be lawyers). But many contracts that do not involve a sale of goods are still governed by old common law principles that have been created by judges over a period of centuries. Which method do you think works better in application? Legal scholars have also written Uniform Penal Code (UPC), which dictates the legal standards used for conviction of criminal acts as well as some of the penalties. Very few states have adopted the UPC, and none have adopted it in its entirety. Why do you think it is that the UCC has been widely adopted but states are reluctant to unify their criminal code? As always, you should state your opinion and comment on another’s opinion. If you are the first to post a comment then circle back later and comment on another post. Your posts must be in complete sentences and of adequate length to display that you have though

Legal Issues Analysis

Before any scientific evidence can be used in court, including what we commonly refer to as forensic evidence, the court must determine whether that evidence is admissible. In 1923, in Frye v. United States, the United States Circuit Court of Appeals for the District of Columbia established what came to be known as the Frye standard. The Frye standard held that expert opinion based on a scientific technique is admissible only where the technique is generally accepted as reliable in the relevant scientific community. Seventy years later, in Daubert v. Merrell Dow Pharmaceuticals, the Court of the United States held that the Federal Rules of Evidence superseded the Frye standard as the standard of admissibility. Some states, however, still follow the Frye standard. After reviewing the required materials and conducting your own independent research into the relevant issues below by reviewing law review articles, treatises, and relate

The Modern Forensics Laboratory

You should come to realize that there are a great number of materials and technologies typically found in a modern forensic laboratory that are used to process and analyze physical evidence that may help solve the crime and may ultimately be introduced in court. Create an outline of those materials and technologies with a brief description (a sentence or two) of each. Using the required readings for this week, choose a specific type of process/analysis you find to be the most significant. Find two additional credible sources from the Ashford University Library (or another resource for finding credible sources) that relate to your chosen process/analysis. Discuss your chosen process/analysis in detail. Include the following elements in your initial post:
  • Outline and briefly explain the materials and technologies typically found in a modern forensic laboratory.
  • Examine how the process/analysis you have chosen is performed.
  • Specify why that process/analys

Trace Evidence

Trace evidence includes many different types of materials. In simplest terms, trace evidence is the term used to describe materials that can be transferred from a person to another person or to an inanimate object during a crime. For this discussion, choose a specific type of trace evidence, outline the history of the use of such evidence, and describe the process for analysis of such evidence. Include the following elements in your initial post:
