case: Silkweave plc

Silkweave Limited ( Silkweave ) is a company which produces and exports high quality rugs and carpets to markets around the world. Silkweave does not have a Human Resource department and outsources any HR problems to Employment Solutions Limited ( ESL).
The following HR issues have occurred at Silkweave and have been referred to ESL for specialist advice .

Silkweave has recently encountered financial difficulties in the UK production site and there has been talk of possible redundancies but no firm proposals have been made. Tina had worked for the company for 3 years, as a part-time cleaner. She has two young children and sometimes, if she could not get anyone to look after her children, she did not go into to work at all, but got her sister, Erica , to cover for her. Keith, Tina’s manager had agreed that Erica could cover for Tina when Tina was not able to get into work. Tina earned £120 per week. Last week she was sent a letter from Keith, calling her to a meeting to discuss redundancy. At the meeting Keith told Tina that he had to let somebody go because of financial pressures and that as Tina was the one with the least service she had been selected. She was told that she would be paid outstanding holiday pay of £50 and that she should leave the premises immediately. Tina is now arguing that she has been unfairly treated.
Andrew, has been employed at Silkweave since July 2011 and works as a salesman promoting silk and wool rugs via the Silkweave web site. Andrew is gay and he recently announced to his colleagues the registration of his partnership with James and that they have set up home together. He discovered a few weeks later that his working times had been altered so that he seems to be working more unsocial hours than others in his office
Andrew asked his line manager Mary for a meeting to discuss the change in working hours but she told him ”you are paranoid – everyone occasionally has to work those hours”. He stated he is not paranoid – and that he had been receiving nasty emails which he believed had come from work colleagues. Mary brushed aside his allegations and told him to ”be a man”. He was so upset he became ill and has taken five days off. Mary contacted him and he said that he is seriously contemplating not returning at all.

Doreen had been with the company for 17 years and is 43 years old. She earned £430 a week as a loom technician. One day Doreen was caught leaving the factory with a small sample of carpet. She was brought into the general manager’s office and accused of theft. She said that the sample was faulty and that her supervisor had allowed her to take faulty samples home in the past. This explanation was not taken seriously and she was told that she should not bother to come in to work the following day. Doreen has written to the general manager stating that she is now contacting a solicitor about the situation.
